My question involves paternity law for the State of: West Virginia.
I currently have a court date coming up soon. I have been trying for almost 3 years to obtain full custody of my son. Every time the court gives the father a pass, and every time it is the same sob story. He comes in, he cries to the Judge, the Judge gives him a lecture, and then gives him a pass. He see's his son one time, and then disappears. I'm seriously tired of this run around game. It's exhausting and I'm just looking out for the best interest of my child, and having his father who likes to disappear after pleading his sob story case, isn't going to help the child in the long run; mentally emotionally, and possibly physically. He does not pay child support, and is probably about 6k in arrears. The father mocks the court by getting a job right before court, keeping it for about 3 payments, and then gets fired; just so he can stay out of jail. I'm just done, and at this point I have taken off the rose colored glasses hoping he would step up and be the father his child deserves and pay for the things his child needs and deserves. I have stepped into reality, and have realized this will never come true. I'm currently okay without child support, however I did use it to buy the child diapers, clothes, new shoes, medicine, daycare fees, etc. If I had any left over I would put it into a college savings fund for him. I have filed my own petition for contempt (I'm a paralegal) in hopes that I can give him an ultimatum; that I will relinquish him of all back owed child support if he signs his rights over. However, here is the stipulation. There are no forms out there for a father or mother to sign papers to relinquish there rights over to the other party. What can I do?
