My question involves child abuse or neglect in the State of: California
A few months ago, I reported my son's ABA company to my insurance for questionable billing practices. Insurance sided with me, in the dispute, and opened an investigation into the agency's billing practices. In retaliation - and within 3 days - the ABA agency maliciously reported me to CPS for "neglect" of my son. CPS investigated and closed the complaint as "unfounded".
Fast forward to today and I am getting my (older) child evaluated for autism. One of the questions in the evaluation questionnaire is --- if there is a history of domestic violence, abuse or neglect in the family, and, if so, nature and extent of CPS involvement (if any). There is NO history of domestic violence or abuse or neglect in my family. Another question right below this, asking us to declare ANY involvement with the foster care system, social services and juvenile justice system. My older child was only questioned by the CPS worker in the process of investigating the referral made about my younger son. There is no other history of involvement with social services and NO history of any involvement with the foster care or juvenile justice systems for my older kid.
CPS social worker told me that since the case was being closed as "unfounded", the investigation would not show up in our background checks. If I admitted that CPS was called on me over my younger child, this information would become part of both of my children's medical records. I am panic-stricken. Since my younger son was the subject of the CPS referral and NO references in that referral were made about my older child, should I answer "NO" to these questions ?
Please help ! How should I handle this ? I know the "truth would set me free", but if the case was closed as "unfounded", why should we have to share info with medical professionals and make a confidential investigation public knowledge ?
