My question involves an accident that occurred in the state of: Wisconsin
Tractors were on display at an event. The owner of the tractors was not there, his employee had brought the tractors. I heard later that the starter (or something) can be taken out of the tractors so that they are unable to be started, but the employee did not do that. He said they never do (they display these tractors at various events, parades, etc. in the area).
Two unattended children (the parents were at a nearby softball game, totally unaware of what had happened) got the tractor started. I don't know the ages of the children, I'm guessing the driver was about 5 or 6, the passenger was about 2 or 3.
The children ended up crashing the tractor into my car.
Three months later, and my insurance company informed me that the owner did not have insurance on the tractors (he is a very well off businessman who owns several.banks, his own insurance company, and I don't know what else). They also tell me that the insurance company of the children's family has denied the claim because the tractor was not a covered vehicle. My insurance company said there is nothing else they can do since I only have liability coverage (my car is a 1999 escort with 130K miles) and that if I would like to be compensated for the damage I need to take someone to small claims court.
