My question involves restraining orders in the State of: Arizona
My ex girlfriend left with my 6mo daughter, and her parents. Then filed a false order of protection claiming I was physically violent with her and her mom. She knows that's not true, and now that I've lawyered up, is scared I'm going to file counter assault, felony theft, and custodial interference charges against her once the truth gets out. I am listed as the father on the birth certificate and acknowledgment of Paternity paperwork, and even though she tried to include our daughter on the Order of Protection, the judge didn't include her, and gave me access to communicate with her in respects to the parenting of our daughter. I haven't seen my daughter since she was less than 4 months old and have only received response from the mom 4 times despite my daily efforts at a reunion with our daughter and a chance to work this out without the courts.
I don't want to retaliate, I just want to have a consistent, meaningful relationship with our daughter and her to simply do the right thing by getting the OOP dismissed. Can she do that?
