My question involves workers compensation law for the state of: West Virginia
I have an ongoing cervical injury due to negligence which I am being treated for by WC. I'm told it will eventually need surgery but not yet. I am managing the pain with Tramadol.
Originally the doctor wanted me taking it 4 times daily. Since I drive a company vehicle this is a problem. I persuaded my doctor to write the script for taking it in the evening. This has allowed me to manage the pain somewhat and still be able to work. But It is necessary by the time I get home to take the medicine as my pain is beyond basic anti-inflammatory medicine.
Prior to taking the Tramadol I was miserable and slept at night upright in a chair. This went on for 3 years. Now I am able to finally sleep in my bed with my wife. So this is necessary for my health and well being.
Now I am having to be call at night on a temporary basis. This has become a problem. I have tried not taking the medicine, but it isn't working well. Days in pain and without sleep are taking a toll on me. I can do 100% of my job function with the exception of being on-call and possibly having to drive somewhere after my normal duty shift ends.
My supervisor is telling me to not to take the meds when I'm on call. It's been asked also that I have the doctor give me something that will enable be to drive if I have too. My doctor said there was nothing. Due to the meds, I have to take a urine test. I have already been warned that if I don't comply with the prescription then I will not receive medication and be dropped as a patient. I was also warned that Comp could also drop me for non-compliance.
I'm between a rock and a hard place. I know the law states that the company needs to find a job I can do. But the way the company looks at it I just need to toughen up and work.
I want to work and I've been toughing it out for 3 years already! Do I have any options whatsoever?
