Hello, I was employed by a staffing agency and was terminated after I reported an on the job injury. Here's the details. I was employed as a research technician and I worked in a lab. We were transitioning some portions of the lab to another part of the facility and I injured my wrist and back. There was a lot of physical activity during the move, which lasted about 2 1/2 weeks.
During the move my wrist and back became sore and I told my immediate supervisor when I originally felt the soreness. I scheduled a doctor visit, because I had a back injury while in the Army. I am service-connected, the staffing agency and assignment supervisor knew of my prior condition. After, visiting my doctor I was informed that I had a pinched nerve and might require surgery. I told the agency and my assignment supervisor about my visit and was instructed to file a formal report. I was then told my doctor would have to provide me with a list of restrictions in order for me to go back to work. It took a week and he did.
During the weeks wait, the agency's staffing supervisor called me and said, "what's going on you haven't called or showed up for work and I'm notifying you that your assignment has ended." (I immediately began recording the conversation) I say, are you familiar with my situation? I explain that you are misinformed and I was just in the office a few days ago about this matter. She puts me on hold, researches the matter, and finds out that I am telling the truth. My doctor provides the restrictions and ask do I return to work tomorrow. They say no you have been let go from your assignment.
I filled unemployment and they are contesting my unemployment claim, citing that I have been fired or terminated. The unemployment commision is going to do an investigation. Not a problem. I found this out today. I was told that I was the best research technician they've had. No issues whatsoever with my assignment.
My question, am eligible for unemployment benefits, if I am terminated after an on the job injury?
