My question involves a traffic ticket from the state of: New York

Yesterday I was pulled over by an officer for driving a commercial vehicle in the HOV lane. Now, the vehicle is a white work van, but does not have commercial plates on it. My boss has regular passenger plates on it. The officer stated that since the van has advertisements on it that it is technically a commercial vehicle.
On each side of the van it has the companys name and a phone number on it. The company on it is KMS Kustoms which is my bosses car shop, not the masonry business that the van is for. Let me also state that the insurance is not for a commercial vehicle either.
Now, my question is do I have a chance to fight this? I want to try because I am 17 and would not like to get any points on my license because I'm still under the first 6 months of probation that you have to go through when you first get your drivers license. What I believe can help me is that on every other vehicle my boss owns (Mercedes Benz, their personal truck, and his brothers suv) he has the same advertisements on them, which are "KMS Kustoms" and their phone number. Obviously those decals don't make a Mercedes Benz a commercial vehicle, so why would they make a van a commercial vehicle.
