My question involves real estate located in the State of: Suwanee County, Florida.
My mother recently gifted me 5.06 acres of property (just land, no house)
and it turns out the legal description is wrong. and has been since she bought the property from her parents in 1980!!!!:mad:
we went last Tuesday to transfer the property over to my name. that Saturday I get a letter from the property appraisers office saying there has been an error with the property for "years" and I need to come in and see how we can resolve it.
so I get to the property appraisers office and the woman tells me the error was made when my parents purchased the property and I should seek Legal advice. I ask her what the problem is and she says that on the legal description it should say South East 1/4 instead of south west 1/4.
So the property appraiser not being of any help, I call my friends realtor (who handles all of his property's) he directs me to go to a local title agency to have them help me out. that day I went to the title agency and from what all I understood the title agency said, is they have to treat this as if my grandparents passed yesterday since they aren't around not write up a corrective deed. which includes a lengthy list of filing fees, lawyer fees,having my moms siblings sign off, etc.
here is a little history on the property.
in 1975 my grandparents bought 10 acres to build a house.
in 1980 my parents bought 5.06 acres of land
in 2005 the property was granted to a trustee (bankruptcy)
in 2011 my uncle sued his siblings on matters pertaining to the other 5 Acres.
in 2016 I acquired the property
so the property can not be put into my name until this gets resolved, let alone sold.
