Custody and Visitation Issues: At What Age Can a Teen Decide Which Parent They Live with in North Carolina

My question involves a child custody case from the State of: North Carolina

My ex-wife's mother has had custody of my children for sixteen years, We are on excellent terms, and until recently the kids spent two weeks with me and two weeks with her, alternating. I voluntarily gave her full custody because of circumstances in my life at that time.

I'm about to move into a place that will make it possible for the kids to live with me. They are 16 and 17. My ex-mother in law has no problem with my 17 year old son moving in with me, but she's resisting regarding my 16 year old daughter, for whom she shows a clear preference. My daughter wants to live with me.

Can my daughter legally decide which parent or guardian she lives with at age 16 in North Carolina? I'd really prefer not to take this to court.
