Fences and Walls: Must a Business Adjacent to a Residential Property be Fenced

My question involves real estate located in the State of: New York
There is a law where I live either New York, or Erie county that a business must have a fence against all residential property.
So my question is since our fence is in really bad condition if we took our fence down would the business have to put up a new one or would it be passed because we took it down.
