My question involves real estate located in the State of: PA
I have a deed that has an "Excepting and Reserving" paragraph included which states:
"therefrom and thereout unto the Grantor is successors and assigns, the full free liberty and right at all times hereafter and forever, of ingress, egress and regress over the Westerly eight feet six inches wide portion of the hereinabove described premises extending Northeastwardly from Poplar Street to the hereinabove mentioned four feet wide alley for purposes of maintaining, repairing, replacing and reconstruction the walls, roof and related facilities on adjoining land of the Grantor, its successors and assigns, or appurtenant thereto."
My question is, is that 8'-6" not able to be built on at all? Or do you just need to be able to pass through it? The previous owner was able to get a fence built on it and through that 8'-6".
