My question involves a consumer law issue in the State of: TEXAS
I will try to make this simple.. traded in/signed over title to dealership A-car auctioned by dealership A-car bought at auction by dealership B-car sold to individual-individual totals car before title was transferred-auto pound coming after me.
I traded in my car and signed over the title (paid in full) to Dealership A on February 3rd. On March 26th, I receive a notice from a tow company that the vehicle was wrecked and towed into their yard. At this point, they want me to pay $809 for this car that is still titled in my name. I call dealership A thinking that there has been a simple mistake that they will correct asap. To my surprise-according to them, they are not legally responsible for transferring the title until an individual purchases the car. I call several different places and find out that the car was sold by dealership A to auction, then to dealership B, and then to an individual. I am told that this takes time but dealership B should get it taken care of. On April 11th I receive my 2nd and final notice from the tow yard, now totaling $1200. I call dealership A back and they tell me that dealership B (dealership that purchased the car at auction and sold it to an individual) is responsible. I call them and they are telling me that they do not have to transfer the title since it was wrecked before the title transfer would have taken place and that insurance should take care of it. I contact someone who works in insurance and am told that they will not do anything until the title is in the individual's name who purchased the car from dealership B. Today, I call the tow yard back and am told that nothing has been done and that the car will be up for auction in 10 days.
Who is responsible for transferring the title? Will this go on to my credit?
