My question involves a child custody case from the State of: Florida
I am the father of a 10 month old girl. Her mother and I never wed.
Mom wanted to move overseas to her home country right after pregnancy. I convinced her to stay by assuring her that I would try to make the relationship work and by providing for a full time baby sitter. I have done both. Her pregnancy was sudden, unplanned, and at the very start of our relationship.
The relationship is no more. I claim it is due to her unwillingness to allow me unsupervised visits with my daughter and her claim is that I lied to her as far as my feelings for her. She believes my only intention was to keep my daughter here in the U.S. from the start. I will admit this is to some degree true. Had I not, she would have left during pregnancy as she threatened to do. Mom comes from a wealthy family that can provide for full time nannies and support her financially. She claims she would not have to work as she does here in the U.S. were she to move back to her home country. She claims it was a sacrifice on her part to stay in the U.S. in order for me to be a part of my daughter's life. I see this different.
Up to about 2 weeks ago we had been spending all week ends together. She would stay at my place with my daughter and we would all hang out. I visited them sporadically during the week and attended about 50% of all doctor visits. We live about 10 minutes apart.
I am currently planning on representing myself pro se as a non lawyer.
Last week I filed the following petitions and supporting documents with the County Clerk:
PETITION TO DETERMINE PATERNITY AND FOR RELATED RELIEF (10/11)FORM 12.983(a),
UNIFORM CHILD CUSTODY JURISDICTION AND ENFORCEMENT ACT FORM 12.902(d)
FAMILY LAW FINANCIAL AFFIDAVIT (LONG FORM)(01/15) 12.902(c)
NOTICE OF SOCIAL SECURITY NUMBER 12.902(j)
DESIGNATION OF CURRENT MAILING AND EMAIL ADDRESS (09/12) FORM 12.915,
CERTIFICATE OF COMPLIANCE WITH MANDATORY DISCLOSURE (09/12) 12.932
I also proceeded to have her served via the county Sheriff.
It is likely she will retain an attorney. She is not taking this well at all. Accusations of me destroying her life and wanting to take her daughter away from her are now common as well as tears, rage and frustration.
It is not my intention to somehow get the lowest possible child support payments or obtain full custody. I already pay more than what the child support guidelines state I should be paying and I will continue to do so if needed regardless of the courts' decision. Shared custody and a reasonable amount of visitation days is all I am looking for. I do not have a criminal record nor do I believe Mom will claim that I have been a bad father. Due to the risk I perceive in Mom possibly leaving the country with my daughter I'd like to request that my daughter's American passport be somehow either confiscated or annulled. I see this as a long shot but I need to try. She already traveled once overseas with my daughter and the letter I wrote granting her permission to leave the country was useless. No one requested seeing any kind of authorization.
Simple question: Are the chances of obtaining the privileges I mentioned before on my own reasonable or should I not risk it and retain an attorney?
