I have a judgment from State Court in Georgia that has become dormant.
GA law § 9-12-60 states that you can file Scire Facias within 3 years of a judgment going dormant, and mine has been dormant for longer than that.
I talked to a collection attorney from Tennessee who wasn't familiar with GA law, but said if the Defendant doesn't show up (and there's a high probability that he won't), that a judge could rule in my favor since no defense was presented.
Could/would a State court judge find in my favor even if that's against the law, because no defense was presented?
