Business Disputes: Deposed As Non-Party, then Get Sued

My question involves business law in the state of: The two members of an dissolved LLC were suing each other for fraud and the LLC (claim, counter claim). Two other members were deposed as Non party. Recently the plaintiff selected one member as expert witness and amended the claims and added one of other member as defendant.

The new defendant participated other depositions/ADR as representative of the sued LLC.

Can I strike the claims since the purpose is for harassment and retaliation.
