My question involves real estate located in the State of: Ohio
We rented a cabin for a weekend on 120 acres. We were told we had access to the property's roads and trails to explore. We took a vehicle on the roads and trails one night to explore the acreage and ended up getting stuck on a hill from some mud. We were able to park a second vehicle at the top of the hill to pull the stuck vehicle out of the mud but we left a bit of a muddy mess. We also left some ruts (no more than 2" deep) in the clearing at the top of the hill where we parked the rescue truck. The owner of the cabin appreciated our honesty when we admitted to the ruts at the top of the hill, but due to his "recent back surgery" he wouldn't be able to repair himself so he will have to charge us. That's fine, we can just head back down to his cabin the following day to repair said "ruts" instead of him having to hire a crew. He declines our offer. He then continues to tell us we have left ruts (again, no more than 2" deep) in parts of the trail and the hill as well so he will be getting a quote and getting back to us with the cost. He informs us "we were not supposed to drive the trails, they are for hiking only". WHAT? These roads are covered in tire tracks from obvious vehicle usage and the owner NEVER specified we could not use them for our vehicles. It wasn't in the contract, there were no signs, no gates, nothing. He "assumed" we knew. Had we known this was prohibited, we obviously would not have done it.
We get a quote for $4200. He has decided to charge us to grade and re-do his entire outer trail system. He decided he needs a DOZER. Mind you this is a dirt road trail system on 100+ acres. Not an access road. We already offered to repair the ruts at the top of the hill where we parked off the road but he declined. He is clearly looking for an excuse to charge an ungodly amount of money. Oh, and he already tried to charge our credit card for the $4200 before we even got the quote.
What do you think? Should we be responsible to pay for the entire trail system to be re-done when we already offered to fix some of it? Mind you, he made a comment that even he does not drive his ATV on the hill when the ground has thawed. Good to know now that we've already done it.
