My question involves child abuse or neglect in the State of: SD
My 9 year old grandchild has been placed with a guardian previously designated by her father by the state of SD due to allegations of abuse in the home by her stepmother towards stepmother's bio-child. Can I take temporary custody of my Grandchild even though I live in MN (about 7 hours away)?
Back story is long: I am maternal grandmother, my daughter lost custody of grandchild to father in 2012 due to drug abuse and neglect. Father has done a great job parenting until this past year when he met and married gf. She has a 3 year old, with special needs from a previous relationship and they have 6 month old twins together. Their relationship has been very rocky, he has alleged abuse by stepmother towards 3 year old in Nov 2015 but nothing was ever done. Now, he says CPS has removed all 4 children due to bruises on the 3 year old and placed them with a family friend, whom he had designated as guardian a few years ago in case anything were ever to happen to him. There is a case plan with CPS, step mom is being charged but he is cleared. Children are still with guardian as of today but the social worker threatened to place them in foster care over an argument--not sure what it entailed, I am being told this by the father.
My daughter is back in inpatient rehab for the 4th time--she is a long term IV drug user who has lost custody of the kids in the past and cannot be an active parent at this time--her 4 year old daughter (half sister to child referenced above) is staying with me until she completes a program and gets stable. We have a stable home and can raise the children if needed.
Should I contact CPS and offer to take granddaughter? Should I hire an attorney? I feel like Dad needs an attorney (legal aid?) or these kids need a GAL. A quick google search shows I may be able to assert grandparent rights but how do I go about it? Call the county courthouse? Please, any advice is welcome--these kids have been through enough!
