My question involves independent contractors in the state of: Missouri
I have a small business and hired workers are independent contractors that I pay using a payroll direct deposit account. A few weeks ago they were having issues with their bank and I asked to stop the direct deposit and wrote checks to my employees and also put out a note that the payroll would be reversing the direct deposit so if they spend it they will have that deducted out of the next paycheck. The place just now this week got back to who was unsuccessful for their deposit and reversals and my last day of business was on 1/17. I have a few employees who now owe between $200 - almost $500 each for overpaid wages they took out of their accounts before being returned basically received two paychecks for only one week earned. I have two questions, will a promissory note for an agreement to repay the wages hold up in court if they fail to meet obligations? If not, how do I recover the overpaid wages?
