My question involves real estate located in the State of: Texas
I will try to be as descriptive as possible without going too long.
We have a farm in a city. (50k people) Our farm is 7 acres and connects to a neighborhood (like a regular suburban type). It's really in a unique area as it is small lot suburban homes adjacent to our land connecting to a broader neighborhood.
A church owns the land behind our land (about 6 acres) and they want to develop the land into a housing area.
The church has said that they have a plan to build on their land (which is fine) except they need to buy a strip of our land in order to connect roads to it.
I absolutely DO NOT want to sell the strip of land to them.
The land will be used as a private development for private homes.
My concern is that they will try to use Eminent domain to condemn that strip on the backside of my property in order to develop homes and have the streets connect.
As far as I know of Eminent domain laws, they should not be able to do this since it will be for a private home development and not for the public. My concern is that they would try to "push it" through the government to force us to sell because it is a "road" they need and it is a "public road" to connect their private development. The only point of this road would be to develop the private homes.... That's it.
I'm actually really concerned because we have a lot of orchard and fruit trees in that area and my children really enjoy playing in that area. We've sold land to the church in the past, but we want to keep our property the way it is now.
Can they take it?
