Land Contracts: Refinancing in Va. with Home Lying on a Right of Way Through My Property

My question involves real estate located in the State of: Virginia
I am trying to re-fi and because the title reads that my property lies on and adjoins a right of way, the underwriters want me to get a letter of maintenance agreement signed. Here's my issue, We are fronting a state maintained road and have installed a private driveway to the road from our house. So we have direct access to the highway. Va required all drives connecting to the state road to be inspected and approved, so I don't see why we have to rely on the wording of the title or consider the right of way at all. Am I wrong? We have refinanced several times in the past 20 years and never had this questioned.
