My question involves collection proceedings in the State of: TX
In 2014 we were pregnant with our second son. I had, and still have, medical insurance through my employer. When I realized that my isurance wouldn't cover all of the child birthing costs, I applied for Medicaid. I figured it couldn't hurt. I was approved and made sure the hospital had both of my insurances on file. A few months after my son was born, I started receiving various bills related to his birth (both of us were covered by Medicaid). The bill showed where my company insurance had paid their part, but not Medicaid. When I spoke with the hospital, they said they only billed Blue-Cross (my employer insurance) for my expenses. I took the bills to the Medicaid office and they made a copy and gave me a reciept for proof that I turned them in.
Now I am getting notices from a medical debt collector for the same bills. I know in Texas we don't pay state taxes. Therefore, a debt collector is unable to garnish my state tax return each year. My question is this: can I be sued for the medical debt? I have tried to research medical debt lawsuits in Texas, but have been unable to find anything.
