My question involves an injury that occurred in the state of Massachusetts. So I was stopped at a red light at 1:30am on a Saturday night, when I was rear ended by a drunk driver. As I looked in my rearview mirror I notice him backing up. So immediately turned on my dash cam and reversed faster then him pulling up behind him in order to read his license plate number. He took off and I followed him while immediately calling 911 on my Bluetooth. The city police said that since he was about to leave town, they would have to connect me to the state police, after following him for about 30 minutes while recording him on a demolition derby on my dash cam the state police finally caught up to us deployed spike strips, which he hit and finally made him come to a stop. They took the upstanding citizen into custody and booked him for an oui, driving with a suspended license, evading, and whatever else other charges goes along with destroying state property(highway sign etc). I went to the hospital for a head injury and also reported everything to my insurance and his insurance as well as set an appointment with my previous lawyer and also set up a consultation with another lawyer. My questions are:
The car was registered and insured under his wife's name and his insurance is declining a rental until they talk to her and go over some coverages. Which is understandable. Can they deny the claim based on what she tells them? I'm thinking what if she says he stole the car?
Also the state police didnt generate a police report with a diagram and my local police don't want to be involved with the report since they never answered the call. The state police has an arrest report that according to them they can't give to me. But said report, according to the trooper, has my name in it.
Is her insurance reliable for the accident???
Who gives me a police report?
Aside from so many questions I have.
also I just went back to work and don't really have the money to pay for a rental until his insurance decide to pay. specially being Christmas after I just spent 500 on gifts and pay the usual bills, rent, two auto loans, insurance etc...
