My question involves judgment recovery in the State of: Fairfax, VA
I received judgement in August 2015 for $22,000. The debt is mine. Its for an unsecured credit card. Anyhow, I live in Washington, DC but the judgement is for a Credit union in Fairfax, VA. The judgement case was filed and entered in Fairfax, County - Virginia. The judgment is a law firm on behalf of the Credit Union. I want to reach out to the law firm and see if I can negotiate a pay plan. Im not able to come up with a lump sum. Im willing to pay between $300-$500 a month. Im going to see if they are willing to do $300 if not then I will counter and go up to to $500. I really do not want to have to file for bankruptcy. I understand its on your credit for 10 years. Plus Im in the process of going to the IRS and working out a deal to pay back taxes. So, Im not able to file until I get my IRS situation straightened out. Im concerned that the law firm will try and go after my wages or file a lien against my condo. I have two. One I live in and one I rent out. I lose money every month on the one I rent out. How long will I receive notice for garnishment or lien against my properties? If I approach the law firm and ask to negotiate a payment plan do you think theyll be open for this. I tried to do this before the court date but the law firm wanted 10K up front. They wouldnt settle for a monthly plan. So, I had no choice but to accept the default decision.
If I approach the law firm, do I have to give them any personal information, like where I work. Or what bank do I use. Or what the specifics about my condo ownership(s)? I do intend to pay them back ALL of the money within the next 8 months. Im suppose to be coming into some money in 2016. Since this happened in August, Im concerned about the following: How soon will they try and garnish my wages or file a lien against my property? When will I receive notification of such? If I get anything like that in the near future, will I be notified first before they do it? What are my options if they do it. Help.
