My question involves defamation "per se" in the state of: California
I'm thinking of Al Franken's book titled, "Rush Limbaugh is a Big Fat Idiot"... people on youtube calling people names. How can I get away with that? BIG problem: It's not my word against yours. It's my word against THEIRS - nine or ten paid employees that contradict me. The two people that WERE my witnesses and told me they would stand up for me have told me, "please don't get me involved" now that the rubber meets the road.
How can I state/post what I know to be fact but cannot prove without being sued for defamation per se? I've already been threatened with a suit and removed the offending content. Does couching comments with, "in my opinion", "it seems to me", "as far as I can tell", "evidently", etc., cover me?
