My question involves defamation in the state of: Mississippi
I was terminated in January of this year and was the assistant manager. I went on maternity leave in September of last year and two of my coworkers told me merchandise was missing but the manager and and 3rd key never reported the shortage but covered it up. I came back to work in December and the inventory was really. We have over 5k pieces and most are counted daily. We have very high clientele and we had so many new employees it was very hard to finish the daily inventory, help customers and assist new employees with issues. When I came back to work, I only knew 2 employees. The other 9 were new and had only been there for 3-4 weeks. I would say it takes about 6 months- 1 1/2 years for someone to fully grasp the business. There was one person in particular that did the inventory count during the week and everyone participated during the weekend. When he wasn't able to locate the merchandise, he would tell me and I would search. Every time a piece was sold it would go against the audit we currently had. So if we sold 100 pieces in an hours, we had to start counting all over. SO it was a nightmare, especially because it was so hard to keep up with and the new employees didn't know how to do it.
The inventory was horrible and the manager didn't care. I tried my best to resolve the issues I could while maintaining my quota. At the end of December, I came into work and the 3rd key and office manager told me a piece valued at 4500 was missing. I looked and couldn't locate the piece. I reported it missing. However, there were a lot of pieces missing over 20k worth of merchandise. It then took me a week, to figure out and fix our inventory which normally takes only a few hours.
Loss prevention came to our store and interviewed everyone. They accused every one of doing it but fired me. They didn't fire me for theft but fired me for manipulation of my quota but I knew they were accusing me of theft. This is a high end jewelry store that has no cameras. During December, lots of pieces were missing and according to Loss Prevention, A lot of pieces were missing during November. I didn't come back until December. There was also over $1,000.00 missing on two days I wasn't scheduled to work.
On September 30th, I was met at my house by a detective. He asked me to come in for some time that week so discuss some things. I went because I had no idea what was going on. He said that my manager accused me of taking the merchandise and the company wants to prosecute me for embezzlement. He said her statement said this, "December the 29th, 2014, I went to a local store and saw the stolen pieced of merchandise from our store in a display case with the tag still on it." What's crazy is that this store mainly sells school uniforms, hair, hair supplies, costume jewelry (nothing over $10). I know the 3rd key helped her create this story because the manager just moved here from Arizona and we only worked together 2 weeks before I went on leave. My sister use to work at that store 3 years ago. The only person that knew that was the 3rd key. The detective accused me of stealing the piece and selling it there because I had a connection through my sister. I told him I didn't do this and this was fabricated to implicate me to cover themselves.
The local store has already been investigated by the police months before I was interviewed I guess to see if they buy or sell jewelry and they told them no because they don't. The 3rd key, quit in July. She contacted me last week and apologized for hurting me and said nothing was intentional. I told her I didn't appreciate my name being dragged through the mud and accused of a crime I didn't do. She said that she was told I was set up to be fired because the district manager didn't like me. She also said merchandise and money was still missing even after I was fired. She also said the loss prevention kept interviewing people about the ring and trying to figure out who stole the ring even months after I was fired.
The manager has told everyone in our mall and some customers that I was fired for stealing. She fabricated this lie of going to a store that she would never shop in a saw a ring she never saw. People in the mall have told me that she has told them I was fired for stealing. I never stole anything from there. I worked there 7 years and never took a thing.
Do i have grounds to sure the company or my boss for this? So far, I haven't been contacted by the detective again. I am angry because they are literally ruining my name. I know a lot of people in this area and I had a great paying job there before I was falsely accused of this. The 3rd key mentioned that things started happening to her as well. Like more money started missing when she closed but the manager opened that morning (they don't count the drawer during the day).
