Employee with new (one) child, joins company in mid-october. Representative misleads employee and enrolls her in Dependent care FSA from November 1, by claiming that all annual expenses can be claimed saving pre-tax and urging to put aside 1000$ in bi-weekly paycheck. Gullible employee falls for it.
Coverage start date is mentioned as November 1st and 5000/annual on paper, but deviously, funds are deducted from mid-october itself - twice on same november paycheck. $4000 funds are deducted from her wages in just 3 paychecks!!
Meanwhile work conditions are horrible and the employee loses job by November 25th.
When employee wants to claim her DCFSA funds with her annual expenses, company denies saying coverage is only for claims from November 1st to November 25th and all the other amount (nearly $3000) should be forfeited back to the company.
Is company doing fraud here? Can the employee have any legal action against the company? Thanks in advance!
