My question involves labor and employment law for the state of: Ohio
I was hired at a place over a year ago as a salaried employee, my job description provided by the company calls for 55 hour work weeks. For the first 11 months, I was around 55-60 hour a week. At this time the ownership fired my boss, my bosses boss and another high manager. I was forced to absorb my bosses entire workload, as well as more from the other two terminations.
At this point my weeks jumped to 90+ hours per week in my physically demanding job. On multiple occasions working more than 110 hours per week, with shifts lasting over 24 hours at a time all with no breaks. I requested to take 5 days of my accrued 15 days vacation, and it was denied. (my new boss actually threw my request forum in the trash.) I was forced to work 7 day weeks for over two months. The only "time off" I received was two days to attend a required seminar) I let my management know that my body could not take the abuse and I needed time off. The response I received was "if you don't like it, quit."
I tried my hardest to tough it out, after having worked a 21 hour day, I had to be back 4 hours later. I came into work, and decided I've had enough. I threw together a simple resignation letter, and submitted it. In the letter I stated that I would be taking the rest of the day and the next day as "personal days" (I had 8 personal paid days)
I was asked to not come back to work.
I believe they classified me as "exempt", however most of my duties and time spent was doing the same thing hourly employees did, to save on labor.
First off, I was not paid for the two days I took off, even though I had worked 5 days of the work week.
Second, I've applied for unemployment, but the company has contested my claim. Do you think I will win my claim if it goes to court based on the information given?
