I'm not sure how the statute of limitations applies in a civil action. Assume State court.
2/1/xxxx: plaintiff commences lawsuit against defendant.
3/1/xxxx: that's the date, per statute limitations, of that offense (meaning that the offense occurred 'n' months earlier)
4/1/xxxx: plaintiff serves summons and complaint upon defendant.
Since plaintiff served later than 3/1, did he miss the statute limitation?
How does the answer change if in Federal court?
