My question involves a child custody case from the State of: Virginia
I have had legal court ordered custody for the past year, however I have had my grandchild the majority of his life (only a few months was he with his mother). My child has now decided after 4 years and only seeing the child a handful of times that they want him back. What are the chances of them getting him back. They are not together but have now decided they want to co-parent. From Jan 2015 until approximately 1 week ago she was living in my home in NC...however, I reside and was granted custody in VA. She was supposed to pay 250 in rent a month which of course most of the time I didn't get. When I first took physical custody of my grandson she was getting food stamps, child support and medical of course none of that was ever sent or used for my grandson. Last year she saw him once and this year so far she has seen him twice each time just for a day. She now says she has an apartment, is getting child support again has a car and is working two jobs and has a new boyfriend and they want him back.
She is my 8th child (adopted) and is now throwing the I'm not her mother card in and saying therefore I'm not his grandmother and when she gets him back I will never see him again. My Grandson has after 4 separate week stays in hospitals been diagnosed with severe separation anxiety (anytime he's away from home and his normal environment him becomes extremely ill) which she refuses to acknowledge.
The two times I've let her take him away from my home for the day there has been issues with him being returned. What are the chances of her getting him back? and what steps will she have to make to do that?
