My question involves an easement in the state of: North Carolina
The land is land-locked with no known written easement/right-of-way. The land has been in my fiance's family for generations, so there is a driveway going across neighboring lands that has been used since the latter 1800s to early 1900s.
At this point, the driveway is approximately 14-16' wide. The problem being that we are looking to move a double-wide mobile home onto the and which (according to the mover) we will need a drive way at the least 20-22' wide due to the moving equipment, truck swing space needed, and so forth. The neighbor doesn't seem very pleased with the idea that we need to widen the driveway (believe he is concerned someone else is going to try and develop land behind my fiance's family's land into a mobile home park or some such fantasy) and has very politely told us that we can trim back the hedgerow but not widen it.
I've been looking online and have about killed my eyes in reading over the past 24 hours trying to find something that could help us in this plight.
From my understanding, we are most likely just out of luck, but I hoped maybe someone with more understanding of the law would be able to inform me.
Is there a minimum right-of-way width within NC or is there any chance that we could get this fixed up where we could do something even without his consent. I most certainly don't want to do anything wrong is why I am asking what would be my options.
