My question involves a consumer law issue in the State of: California
I am a newer, small retailer. I have had several instances where a price sticker has ended up on the wrong product, possibly put there by a "customer" (aka "thief"), or possibly by a sloppy employee. I'm pretty sure that I am legally required to honor the lower price on the sticker, unless I can prove that it was switched to the higher priced item by the thief.
My question is this. If the price sticker includes a SKU, and the SKU does not match the SKU of the product when scanned by UPC, am I still required to honor the lower price? i.e. do I have a case to tell/show the customer (and/or thief) that the price tag on the item is not intended for that item, as specified by the SKU? By showing that the SKU does not match the item, have I adequately proved that the sticker is incorrect and thus I don't have to honor the price on that tag?
