My question involves an injury that occurred in the state of: New York, County of Queens
Pulling out of a parking space on busy street with lights. While the light was red I inched out and when the light changed I stopped and was waiting for light to change again to continue because there was no way to pull out while light was green. This truck that's narrow in front and wider in the back comes speeding his front clears but his back rips my bumper of my brand new 2018 100 mile honda civic causing $5,000 in damage. He comes out screaming didnt I see him and I proceed to tell the wack job that I wasn't even moving. He doesn't want to go through Insurance because it was my fault and I insist because I was still. So no I find out my company being lazy said that I am responsible because wack job said I was pulling out and its his word against mine. My question is can't they tell by the hit who is at fault and considering that he had no damage because the middle of his truck pulled my car that was standing still?
