A judment creditor in NYC aggressively pursues money judgments against judgment debtors that owe monies for debt.
Let's say the original judgment creditor, has reason to believe that judgment debtor is working for XYZ Industries and has marshal or sheriff serve a wage garnishment.
However, following service of the garnish order, it turns out that debtor is not working at XYZ Industries.
Is the creditor still permitted to include the cost of the failed garnishment order in the judgment amount (memorandum of costs)?
