My question involves landlord-tenant law in the State of: California
Hi, I have two questions:
1) I rented a room with the lease expiring in mid-August, but on June 29th, I received a text from the roomie saying all her stuff is gone and she has moved out. (We were friendly so her sudden disappearance without talking to me first was a huge surprise.) How do I collect for the lost rent, cleaning fees, etc.? Is small claims my only option? (I don't have her ss# so I can't report it on her credit, which would have been good leverage.) I've made a good faith effort to re-rent but it's a college town and people move in seasonally. I will have someone new in mid-August. Can I hold her liable for all rent up to that point, which is what we agreed to?
2) I rent the bedroom at slightly lower than the current market rate; however, it is about 65% of the actual rent. I've lived here forever so, even though it's not rent controlled, rent has only increased by so much each year. I have disclosed to my future roommate that she is paying more than half the rent but she hasn't asked for details so I haven't given her an actual amount. Am I obligated to disclose or am I within my rights since I am not charging more than market rate? If she asks me and realizes she is paying more than half, can she request a refund of all back rent?
