I recently obtained legal guardianship of my sons child, he is active military stationed in another state. My only income is SSDI below the taxable rate and he currently pays not only everything she needs but helps with my car insurance, property taxes, groceries, provides her insurance and such. Single parents in the military have to designate someone to step in for them to care for their child (he signed the consent for me to gain guardianship with the courts, power of atty through military etc) and the mothers custody was removed and given to me. In this case he cant have physical custody because of his military duties. My SSDI is below the taxable limit so even if I filed I wouldnt be eligible for the EIC or Child Tax Credit. The mother is looking at very possible jail time in the future and is currently working less than 12 hours per week minimum wage from what I've heard not contributing to the childs care at all.
Can he claim her on his taxes as he is clearly supporting her financially and even providing extra $ to the household bills to make sure she has everything he needs?
