My question involves collection proceedings in the State of: VA
I am considering taking my ex (not married) to smalls claims court. While we were together to accumulated a whole bunch of debt. Most of it is in just my name so I know there is nothing I can do about that. But there are 3 accounts that are in both of our names. I am the only one paying for it. The debt altogether was about 12k and is now down to less than 5k.
I know it would be worth the money. Especially since he is also not paying child support. But would it be possible to do that? Is it enough that both of our names are on the account? Or do I need more to prove that he should partially responsible for that money? Also, the debts are about 3-4 years old, I used to ask him in the past for payments but he always refuses, do I still have a chance to get something?
