My question involves a child custody case from the State of: New York
My boyfriend and his ex wife had a very amicable divorce(for the most part). They agreed to joint custody and joint physical custody. The two children spend equal time at both houses. They came up with an amount of $650 a month for him to pay in child support. He carries a family health plan and covers both the girls and their copays are shared 41% for her and 59% for him. He makes roughly 25k more than she does so she is listed as the custodial parent. Their divorce states that they are to equally share the extra curricular activities and all other expenses. Every time something needs to be paid for, such as dance tuition, or some other activity, she argues and tells him she doesn't have the money and reminds him that she let him off the hook because he should have been paying a lot more for support. @650 a month he is taking 7,800 off of his taxed salary and adding it to hers tax free, plus the added cost of carrying the family plan and the additional medical expenses. My question is, with complete joint physical custody what would his obligation be for child support? If he paid the 25% of his income that she keeps threatening him with, she would be making more than him. Any information would be helpful.
