Suspension and Revocation: License Revoked, Criminal Case Dismissed

My question involves a driver's license issued by the State of: California

I have 3 DUI arrests in 10 years according to the DMV. The 1st one was never filed by the DA (I was sleeping in the car, not driving.) The 2nd was a conviction in 2008. The 3rd was dismissed this week (also sleeping in the car, but also refused tests). They revoked my license for 3 years for refusal but I only have 1 conviction. Do I have any recourse? It's been more than 14 days since my (unrepresented) hearing, which did not go in my favor. On the DMV website it says the penalty for refusal after 3 offenses is 3 years revocation. It does not define offenses. I called the driver safety office in El Segundo and asked. At first I was told an offense is a conviction. After I explained my situation the clerk about-faced and said an offense is not necessarily a conviction, but could not come up with an adequate definition. Somehow I think I'm getting hosed by having a 3 year revocation when I only have 1 conviction. I read about the form that I can get to have the DA fill out and send back to the driver safety office or DMV. Would that help? I wasn't driving and there's no proof that I was. Why should I have to take a chemical or other test if I wasn't driving?
