My question involves landlord-tenant law in the State of: New York City
I can only hope someone will help me out with my current situation.
I had to move out of my very legal home to a very illegal sublease. The woman is a disaster, I can't even begin to run down the list of things all wrong with her and the place. I signed a "sublease" stating I can't move anything in the room or the apartment, I can't cook, use anything "smelly" and the list goes on and on. She left boxes stacked from floor to ceiling with glass plates on top of them to fall on me (unsafe living situation) and the day I moved in, there was a pile of shredded paper and wine bottle all over the place and she didn't leave me enough storage for my things.... she is a disaster. From the get-go I knew there was something wrong with her but I needed to get out of my current situation ASAP. Long story short, my instinct is correct.... She took $5,000 dollars from me and we, the other woman I am leasing with, started getting notices that she hasn't signed her "Renewal" lease. Did I mention she is not even in the country? It has been a very stressful situation for me and I would like someone to help me with the following questions.
1) She is coming back to the states in February and I don't want her in my room, which was hers and she left a lot of her belongs and I am living out of boxes, do I have the right to tell her she doesn't have the right to enter my room and I will put all of her belongs in the living room with all of the other boxes and boxes of her possessions?
2) What are my rights if I leave the lease before the time I agreed to is up. I was planning on tell her at the end of Feb. I will be vacating March 31 due to unsafe living situation, noise disturbance due to a dog that doesn't stop barking and my neighbor barks at it to encourage it to bark and the people above physically assault each other and I am not comfortable living in an illegal situation. Can she use my lasts months rent, I gave her first, last, and security deposit, if I plan on doing this? Also, does she have the right to keep my security deposit?
