My question involves a child custody case from the State of: AZ
My ex tried to modify our custody agreement and it did not work in her favor. Also in her modification she wanted to modify the child support. When we went to court she told them she lost her job, and was unable to find a new job because she could not afford childcare expenses. We have joint custody. The judge asked why she did not have a job and she claims she got fired the day before coming to court. I provided court with proof of her potential income as well as jobs that were available for her to apply to. They didnt care.
Also the state commisioner is involved because she is on government welfare so DES is on the case, and they are involved with the child support order.
After that court date we went to see the commissioner and the commissioner was not even listening. He asked questions over again that we had already answered. They then slapped me with a very large child support order even though I am on joint custody. My attorney has been useless and tells me there is nothing that can be done.
A few days ago my children reported to me that my ex works now. They dont know where, or when but made comments to me that mom (ex) took their game console to work one day recently and it went dead. They made another comment to my mother that indicates she is working somewhere. It is possible to have her job and be paid cash under the table, which I think may be likely.
Is there anything that I can do? I feel she deceived the court, as it has been less than a month since the order was finalized with the new CS amounts, and she now already apparently has a job somewhere. She gets child support now from me, also gets money from a spouse (I am not married so I do not have that benefit), only has the kids 50% of the time, etc. - I do not feel this is fair. Is there anything that I can do? I have another court date coming up but I was told by my attorney they will not discuss child support because it is a DES issue. I have since released my attorney because I am wasting money there.
