My question involves a consumer law issue in the State of: California
My Durango broke down in June of 2016. I didnt have the funds or inclination to fix it. I posted it on CraigsList as a Mechanics Special for $500 FIRM. A guy came out to look at it and was hemming and hawing about the risk of buying and trying to fix it. He tried to haggle down the price but I wasnt interested. Finally he agreed to $500 and said hed be back later in the day to pick it up, so paperwork and exchange money. He came back, handed me a wad of money which only amounted to $400 (but I didnt find that out until later) signed over the title and he left with the Durango. I was mad about the $400 and I emailed him, but he ignored me.
Now over a year and a half later, hes telling me about all the problems hes having transferring it into his name. First he said that it wasnt a clear title and that it was never released entirely into my name. But I bought it from a dealership like 10 years ago and they would have sent that paperwork to the DMV as a matter of course. Plus I had a clear title to sign over to him. Then he said something about a financing agency even though I never financed it, I bought it outright. Then he said that DMV wanted an updated bill of sale that he drew up and it was not true to the reality of the sale (dates and sale amount different). I told him I wouldnt sign it and in fact I wouldnt do anything at all until I got the rest of the sale price. He told me to go pound sand and I thought that would be the last Id hear from him.
But now hes saying I didnt sign my own name right on the title and that the DMV gave him temp registration with his name and my name on the title. What on earth am I supposed to do? Im 100% sure hes trying to screw me over and get my signature on something fraudulent or get my signature to make up something fraudulent like with photoshop or something. I dont want to help him AT ALL because hes a liar or at least VERY confused.
Can I just go get the car and give him back $400? Can I sue him? Can he sue me?
