My question involves an injury that occurred in the state of: Maryland
Assuming the liability is clear, I would like to have some opinions about whether or not this case would be worth a lawyer's taking of it, if my injuries are not severe enough to rack in big money. I am wanting compensation because I am missing time and pay from two different jobs, and because unless the party responsible for the injury makes compensation, I won't be able to afford to do physical therapy if the orthopedist says I should do it (he probably will, and I will have to decline if I think there will be no compensation).
I will explain why I believe the store is liable for the injury:
I slipped on liquid on the floor of the grocery store, at 11:10 pm Tuesday night.
I had the manager file an accident report with me.
It was in the bread isle, so liquid on the floor in that spot seems very strange to me. I actually slipped a second time when I tried to stand up, because the stuff was very slippery.
After the fall, I was finishing getting items I needed when I discovered a huge puddle of the same slippery liquid, with wheel trails coming from both sides of it, by the entrance door to the employee-only area. I was in that spot because the clearance rack is there, and the big puddle was in front and to the side of the rack, and across that little hall area which leads to the work area doors. I took a picture of this area; I had forgotten to take a picture of the fall area until this point because I was kind of shocked by the fall, so when I took a picture of it, the liquid was wiped off, but still I took a picture of my smudged up foot prints.
Before the fall happened, I had seen an employee cleaning the floor in a different isle, two or three isles away from the bread isle (where I fell). I made a point of the 11:10 pm time above, because it was almost closing time and that is when the floors usually get cleaned. The facts of this floor cleaning, the puddle with wheel trails, and the level of slipperiness of the liquid I fell on, cause me to assume that there was some kind of soap or wax in the liquid which caused me to slip.
All of that explaining done, what do people think? I don't want to deal with lawyers and stuff, but I need to be able to pay for the medical bills which are even less affordable because of the lost pay. I just worry that a lawyer won't want a case that doesn't come with really big numbers, so I will be stuck just because the injuries aren't severe. I am comparing the severity of my injuries to the severity of injuries I had from a past car accident for which I had to hire lawyers; they are sort of high profile thus look for big numbers, so I'm hesitant to ask them to consider this case.
