Somebody is threatening to sue me and they said their lawyer will request subpoena from the website to release my information such as IP address. The internet service for IP address is not in my name but my spouses name and I believe that person knows my gender. If they file the lawsuit in my spouses name, what steps we can take to dismiss it? Is the lawsuit valid if it’s not for the right person but the correct address? Can we file motion to quash if I live more than 100 mikes from the person suing? If motion to quash goes through, am I safe from the lawsuit and my identity is protected?
