I recently got laid off from work about 1 month ago. Applied for unemployment filled out papers to recieve my 401k to help makes end meet during this holiday season. Well just found out my former employer did Not send separation yet to my 401k because HR person is on medical leave? What? for how long that can be months....What are my rights? Is the this something the labor commission should look into? Sorry for all the questions but I'm pretty desperate. Is this a certain law penal code I can show my former employer. There is to be a time limit to get my money. I think 30 days after you get a lay off is unacceptable. And why is the HR going on medical leave have to be my problem?? Don't they have people who take over during that time?
