Criminal Law Issues: F1 with a Dismissed "Theft of Service" and Needs to Travel

Hi Experts,

I am a grad student on a F1 visa. In 2013, when I was a undergraduate student, I was defrauded by a gypsy taxi driver (unregistered Lincoln town car with no Medallion). For a $40 maximum cab ride, the driver was trying to charge me $130. I called the cops to remedy the dispute but instead they "brought me to the precinct to help me". I only realized that it was an arrest when I got finger printed in the precinct -- the cops never announced that it was an arrest, no miranda rights or handcuffs. In the same year after a few court appearance, my case was dismissed and the judge commented that "it was the most expensive ride in NYC I have ever seen".

I had to stay for the court and my visa expired in 2013. Since then I remained in the states with legal F1 status. Now I have one semester of graduate school left and a job offer. I really want to travel back to my home country this winter. I have consulted with two immigration lawyers. They all told me that they do not see any issues with me getting another visa. But this is a very hard decision to make and I would love to hear your takes.

Do you think I have a chance of getting a visa and come back? Or should I stay until I get H1-b sponsorship going in 2018?

Much appreciated,
B
