My question involves a consumer law issue in the State of: Florida.
I hired a flooring company to install flooring in an apartment; the flooring company's driver, while operating the company van caused damage to the common areas of the building.
The contractor has refused to pay, even though their employee was driving their company vehicle at the time; now the HOA is threatening to sue me because they say I, as an owner am responsible for the damage caused by the contractor. I suggested the HOA take the contractor to small claims court but instead I am the one being sued? The damage caused is approximately $3,000.
The contractor has and provided copies of their insurance to the HOA prior to the job starting;I am not on friendly terms with the contractor any longer.
