After college I couldn't find a job for a few months and couldn't pay rent for the last month and a half of my lease. I moved out of the apartment and handed in my keys. With less than a month left on the lease, I got a call from my neighbor saying that there was an eviction notice on my front door. I called the management company and asked why they would evict me when I had already vacated the apartment, and they said it was to ensure that I paid my debt, a little under $400 for the pro-rated remainder of my lease after keeping my security deposit (which I know is actually technically illegal according to state law in NC. Security deposits are to be kept only for damages done to the property and not for back rent) While I don't understand why you would evict someone rather than contact a collection agency is beyond me, but my real question concerns whether or not it was legal for them to evict me after I had already moved out. Although I'm having trouble finding the lease and can't remember the exact move out date, I'm pretty certain that the judgement to evict me was passed after the lease had already ended. This doesn't seem like it should be allowed to happen, but I haven't been able to find any laws that expressly forbid it. Do I have any recourse here?
