My question involves a child custody case from the State of: new york
My childs non custodial parent and I have joint legal custody and i have sole residential custody with dss supervised visitation. This was established in 2011. The noncustodial parent was asked to take parenting classes, have acceptable housing and go through a psych evaluation, since then he has made 1 visitation appointment back in 2011 and has not made any effort to do anything the court asked, since then we have had no contact for over 5 years because his number has been disconnected.i have also learned he has moved and not notified the court, and has 1 year of past due child support. My family (me, husband, and childs half sibling) and i plan on moving out of state, and were wondering if it is worth it to go through the hastle of court or would we just be able to pack up and go? What can happen to the non custodial parent if it is determined he abandoned his child. If this is tue case would we still have to ask permission to relocate?
