My question involves criminal law for the state of: georgia
I was accused and charged with Theft by Taking (over $1,500) by my former employer. My previous Roomate pawned Tools that belonged to the company i worked for, My line of work in construction they supplied me with the tools. She still has a warrent for her arrest with a charge of Theft by Receiving. Aside of being accused and the pawn tickets that were found in my home in her name my only fault is being associated with this person. The last time i was in court the Prosecutor offered me probation and to pay all of the restitution. I have a big issue with all of this naturally because i didn't do anything wrong and it seems like because i was picked up on the charge against me that they're trying to get me to make a plead agreement and repay for the tools plus have the charge on my record for the extent of the probation being i've never been in trouble before as a 1st offender. I have a public defender and he said i do have a good defense but said i need to figure out if i want to take it to trial and risk jail time? So im just not sure what to do? Can i be convicted on sole accusation and association or does there need to be proof/evidence? I'm just scared to death about this situation due to ruining my clean record and effecting my future employment and also having to pay for items i didn't pawn. Any advice is thankful. Thank you
