Workers Compensation Issues: Can a Minor Sue an Employer Over an Injury Based on a Work Permit Violation

My question involves labor and employment law for the state of: Ohio

Long story short:
17 year old employed by temp agency. Sent to lawn and garden retail shop to work. Temp agency says you can not work until we have permit on file. The site owner insists it is ok. 17 year old goes to work. Works several weeks with out a permit. Is off for medical recovery for a couple weeks. Returns one week into summer break. Still no permit on file. Is severely injured doing a prohibited/hazardous employment the second day he returned to work. Would not having a permit on file provide any window for him to say he was illegally employed therefore negating the employer/employee relationship. We are looking for a way around sole remedy of wc since the employer was insanely wreckless (was notified the week and the day prior to my sons injury- that minors could not work on the equipment). Sorry grasping at straws.
